1. Acceptance of Terms

By accessing our website, by submitting a reservation request, or by staying at the lodge, you accept these Terms of Service and agree to be bound by them. These terms apply to every visitor, guest and event host, whether you book directly or through a third party.

If you book on behalf of another person or a group, you confirm that you are authorised to accept these terms for every member of the group, and that each member has agreed to follow the rules described here. The person who makes a booking is responsible for ensuring that all members of the party are informed of these terms before arrival.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue to apply. The fact that we do not enforce a provision at one time does not mean that we waive our right to enforce it at another time.

These terms, together with our Privacy Policy, form the entire agreement between you and Aspen Glen Solitude, LLC regarding your use of our website and services, and they replace any earlier agreements or statements about the same subject.

2. About Our Services

Aspen Glen Solitude, LLC operates a mountain lodge and retreat in Big Cottonwood Canyon near Salt Lake City, Utah. Our services include lodge rooms, cabin suites and group chalets; ski and snowboard access arrangements; group retreats and events; dining and après offerings; trail and outdoor activity planning; and concierge and transport assistance.

The services we provide, the prices we charge and the availability of any particular room or activity may change from time to time. We describe our services on the website to the best of our knowledge, but we do not promise that every description is complete or that every service will be available on the date you request.

Some activities described on our website, such as skiing, hiking, biking and fly fishing, take place in a mountain environment and involve natural risks. We provide information and arrangement services to help you enjoy these activities, but we do not operate ski lifts, trails or guiding businesses unless we state otherwise.

We may modify, suspend or discontinue any part of our services at any time, with or without notice, where necessary for safety, maintenance or operational reasons. We will make reasonable efforts to inform you of any significant change that affects an existing booking.

3. Bookings and Reservations

A reservation is confirmed only when we send you a written confirmation by email. Until that confirmation is sent, a request for a room, a chalet or an event date is not a confirmed booking and does not guarantee availability.

When you make a booking you agree to provide accurate, complete and current information, including your name, your contact details, the size of your party and any requirements that affect your stay. If you provide incorrect information, we may not be able to prepare the stay correctly and we may need to adjust the booking.

Rates and availability are quoted for the specific dates and the specific room or chalet you select. Once confirmed, the rate for your stay is held at the quoted amount, subject to the payment terms described below. Any additional services you add during your stay, such as dinners, transfers or activity bookings, are charged separately at the rates then in effect.

We reserve the right to decline a booking for any lawful reason, including where we have concerns about safety, where a party exceeds the stated capacity of a room, or where a previous booking was not handled in line with these terms.

4. Pricing and Payment

All prices are quoted in United States dollars unless stated otherwise. Published rates are subject to change for future dates, but the rate confirmed for your booking is honoured under the terms of that confirmation.

At the time of booking we require a deposit to hold the reservation. The deposit amount is shown before you confirm and depends on the room or chalet selected and the length of the stay. The balance is due before arrival, on the date set out in your confirmation email, unless we agree otherwise in writing.

We accept major credit and debit cards. Payment is processed through a regulated payment provider. You agree that you are authorised to use the payment method provided, and you authorise us to charge the deposit and the balance to that method as described in these terms.

Our lodge is subject to applicable taxes, fees and local charges. Where taxes are not included in the quoted rate, they will be added at checkout and explained on your invoice. You are responsible for all charges associated with your stay, including any additional services you request during the stay.

5. Cancellation and Refunds

You may cancel a reservation in line with the policy below. The policy that applies to your booking is the one shown in the confirmation email you receive.

Cancellations made fourteen or more days before the arrival date receive a full refund of the deposit. Cancellations made fewer than fourteen days before arrival transfer the deposit to a credit for a future stay within twelve months of the original arrival date. No-shows on the arrival date are charged the full balance of the booking, and the deposit is not refundable in that case.

If you shorten a stay after arrival, the nights you keep are charged at the confirmed rate and the released nights are not refunded unless we are able to re-sell them. Early departure does not cancel the obligation to pay for the nights you reserved.

If we must cancel a booking because of weather, safety conditions, maintenance or any reason within our control, we will offer you an alternative date, a credit or a full refund of any amounts paid. We will not be liable for any further costs you incur as a result of a cancellation made by us, including travel costs.

6. Guest Responsibilities

You are responsible for the conduct of every person in your party. You agree to treat the lodge, its staff and other guests with respect, and to follow all instructions given by our staff, including instructions about safety, quiet hours and the use of facilities.

You are responsible for your own safety and the safety of the children in your party. Mountain environments include steep terrain, cold weather, wildlife and rapidly changing conditions. You should dress appropriately, tell us about any activity that concerns you, and ask for help whenever you need it.

You agree to report any damage to the room, the chalet or the grounds as soon as you become aware of it. Damage caused by negligence or misuse may be charged to the payment method on file for the booking.

Quiet hours run from 10:00 pm to 7:00 am. Guests are expected to keep noise at a level that does not disturb other guests during quiet hours, and to respect the peace of the canyon at all times.

7. Prohibited Conduct

The following conduct is prohibited at the lodge and on the property: smoking inside any building; using open flames inside rooms; bringing fireworks or weapons onto the property; possessing or using unlawful substances; operating drones or remote aircraft without our permission; and entering staff areas or closed areas of the property.

Guests may not exceed the stated occupancy of a room or chalet. Additional guests beyond the confirmed number are not permitted without our advance agreement, and they may be refused entry or charged the applicable additional person rate.

We prohibit any behaviour that endangers other guests or staff, that damages property, or that interferes with the operation of the lodge. This includes threatening behaviour, harassment and any conduct that makes other guests uncomfortable.

If we determine that a guest has breached these rules, we may ask the guest to leave the property immediately without refund, and we may report the matter to the authorities where the conduct is unlawful.

8. Facility Rules and Safety

The lodge, the chalets and the surrounding grounds are used at the risk of each guest. We maintain the property to a high standard, but natural features such as slopes, trees, rocks, creeks and wildlife carry inherent risks that cannot be removed.

Children must be supervised by a responsible adult at all times. The hot tub is used at your own risk, and we ask that children and non-swimmers are kept under close supervision near water. Fires are lit only in the designated fireplaces, and fire safety instructions are posted in every room.

Weather in the canyon can change quickly. Road access may be restricted in winter, and we recommend that vehicles are equipped for mountain conditions. Guests who travel to the canyon accept the risks of mountain driving and must comply with local road rules.

If any facility is closed for maintenance, repair or safety reasons, we will inform you where possible. Closure of a facility does not reduce the balance owed for a confirmed booking, but we will make reasonable efforts to offer a suitable alternative.

9. Events and Group Bookings

Weddings, reunions and retreats are covered by these terms plus any event-specific agreement we sign with you. Where an event agreement exists, its terms take precedence over these terms for the matters it covers.

Event bookings often require a larger deposit and a firmer cancellation schedule than standard room bookings, because events reserve staff, catering and the whole venue. The deposit and cancellation terms for your event are set out in the event agreement or, if no separate agreement exists, in the confirmation email for the event.

The event host is responsible for the conduct of all attendees, for the decoration and clean-up arrangements we agree, and for any damage caused by attendees. Decorations and vendors must be approved by us in advance, and no open flames are permitted inside the buildings.

Music and amplified sound at events must be kept to levels that do not disturb neighbours in the canyon, and must end by the time agreed in the event plan. We reserve the right to step in if sound levels are unreasonable.

10. Luggage and Personal Property

You are responsible for your personal property during your stay. We provide in-room safes for valuables and a secure gear room for skis and boards, and we encourage you to use them.

To the maximum extent permitted by law, Aspen Glen Solitude, LLC is not liable for the loss, theft or damage of any personal property brought onto the property, unless the loss results from our own negligence. Vehicles parked on the property are parked at the owner risk.

Items left behind after a stay are held for thirty days where practical, and we will contact you if we have a way to reach you. After thirty days, unclaimed items are donated or disposed of. Fragile or perishable items cannot be held.

We do not accept responsibility for the contents of vehicles, including luggage, ski equipment or bicycles stored in vehicles or in outdoor racks.

11. User Submissions

If you submit reviews, photos, comments or other content to us, whether through our website, by email or through social media, you grant us a non-exclusive, royalty-free licence to use, display and reproduce that content for the purpose of promoting and operating the lodge.

You confirm that any content you submit is yours or that you have the right to share it, and that it does not violate the rights of any third party. We may refuse, edit or remove any submission that we consider inappropriate, unlawful or contrary to the spirit of the lodge.

We are not obliged to publish any submission, and we may use submissions for promotional purposes without payment to you. If you do not want a submission used in this way, do not send it to us.

Personal information contained in your submissions is handled in line with our Privacy Policy.

12. Intellectual Property

All content on our website, including text, images, logos, graphics, illustrations, the mountain and pine tree marks, and the arrangement of the site, is owned by Aspen Glen Solitude, LLC or its licensors and is protected by copyright, trademark and other intellectual property laws.

15. Limitation of Liability

To the maximum extent permitted by law, Aspen Glen Solitude, LLC and its owners, directors, staff and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the website or the services, including loss of profits, loss of data or loss of enjoyment.

Our total liability for any claim arising out of or related to these terms, the website or the services will not exceed the amount you paid to us for the relevant stay or service giving rise to the claim, or one hundred United States dollars if no payment was made.

Activities in the mountain environment, including skiing, hiking, biking, fishing and transport in the canyon, carry inherent risks. You accept those risks, and our liability for injuries or loss arising from these activities is limited to the maximum extent permitted by law.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless Aspen Glen Solitude, LLC and its owners, directors, staff and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or related to your use of the website, your stay at the lodge, your participation in any event, or your breach of these terms.

This indemnity covers claims made by third parties, including other guests, visitors and our staff, that result from your conduct, the conduct of your party or the content you submit to us.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you. In that case you agree to cooperate with our defence and to bear the costs of the matter as described in this section.

This section survives the end of your stay and the termination of these terms.

17. Termination

We may suspend or terminate your access to the website, or cancel a booking, at any time if you breach these terms, if we suspect misuse or fraud, or if we are required to do so by law. Where we cancel a booking for a reason that is your fault, the cancellation policy in section 5 applies.

We may also terminate or suspend our services, or any part of them, for operational or safety reasons, in which case we will honour or refund affected bookings as described in the cancellation section.

On termination, the provisions of these terms that by their nature are intended to survive, including the sections on intellectual property, warranties, liability and indemnification, continue to apply.

You may cancel your booking at any time in line with the cancellation policy, and you may stop using the website at any time. Termination of your use of the website does not release you from payment obligations already incurred.

18. Governing Law and Disputes

These terms are governed by the laws of the state of Utah, United States, without regard to its conflict of law principles. Any dispute arising out of or related to these terms, the website or the services will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to the jurisdiction of those courts.

Before filing a claim, you agree to make a good faith attempt to resolve the dispute informally. You should contact us at inquiry@aspensolitude.buzz to describe the issue, and we will respond within a reasonable time and work with you to find a fair resolution.

If the informal process does not resolve the dispute, either party may then bring the matter to the courts described above. You waive any objection to venue based on inconvenience of forum.

To the extent permitted by law, any claim must be brought within the period required by the applicable statute of limitations, and you agree that claims are brought in your individual capacity and not as part of a class action.

19. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, in the law or in our operations. When we make material changes, we will revise the effective date at the top of this page and, where practical, we will draw the change to your attention on the website.

The updated terms apply to bookings made after the new effective date. For bookings made before the change, the terms in effect at the time of booking apply, unless the change is required by law.

We encourage you to review these terms periodically. Continued use of the website or the services after a change takes effect means that you accept the updated terms for future use.
